Welcome to Maestro, a personal online media accessing and networking service operated by Maestro Music Inc. and/or wholly-owned subsidiaries ("Maestro") which includes Maestro software, content, related documentation, information on the Maestro domain, and information made available by users to each other on the Internet through the Maestro Software (collectively, the Service). We value your privacy, and have designed the Service to give you choices about the personal information available. This Privacy Policy explains how Maestro collects, uses and shares your personal identifying information. Please read this Privacy Policy carefully, and if you have any questions, feel free to contact us. In the event of a conflict between this Privacy Statement and our Terms of Use, our Terms of Use takes precedence. By using the Service, you consent to the collection and use of your personal information as outlined in the Privacy Policy. From time to time, we may update the Privacy Policy and we will post a notice of significant changes on the web site www.maestro.fm. You should visit this page periodically to review any such changes to the Privacy Policy. What We Collect When you register to become a member of the Service, we collect your name, email address and other personal identifying information that you submit. Also, as part of your personal profile, you may choose to make available additional personal information such as gender, age, occupation, hobbies, interests, etc. and other content, such as photos, titles in your music library and blogs (web logs). This additional information is voluntary and can be made available to other members. To protect your privacy, the Service allows you to limit who can view your personal information. These options can be set in the Maestro client application under Settings, Privacy. When you invite new members into your network or send messages through the Maestro service, we collect and maintain the information associated with those messages, including email addresses and content on secure servers. As with any social networking service, you should use care when disclosing your personal information to strangers. Be advised that if you send messages or post material containing personal information, that information may be collected and used by others. In order to provide the best possible service and fulfill our reporting obligations on webcasting of music, we collect aggregate information about your use of the Service. How We Use Your Information We make your profile and other user information available to other users according to the privacy settings you set for yourself. When you send messages through the Service, your user name will be identified in the message. We also use your name and email address to notify you of new product releases, service notifications, and to solicit your feedback and input. You understand and agree that Maestro may access, preserve, and disclose your personal information and the contents of your account if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to comply with legal process, such as a search warrant, subpoena, statute, or court order, or to protect the rights and property of Maestro, its affiliates or the public. - If you submit personally identifiable information to us through the Maestro Sites, then we use your personal information to operate, maintain, and provide to you the features and functionality of the Maestro Sites. - Any personal information or media content that you voluntarily disclose online (on discussion boards, in messages and chat areas, within your public profile page, etc.) becomes publicly available and can be collected and used by others. Your account name (not your email address) is displayed to other Users when you upload videos or send messages through the Maestro Sites and other Users can contact you through messages and comments. Any media that you submit to the Maestro Sites may be redistributed through the internet and other media channels, and may be viewed by the general public. - We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major Maestro Site changes or for customer service purposes). - We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, click stream data, etc.) to improve the quality and design of the Maestro Sites and to create new features, promotions, functionality, and services by storing, tracking, and analyzing User preferences and trends. - We use cookies, clear gifs, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Maestro Sites; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests. Maestro Software The Maestro desktop software application resides on your computer. At certain times, such as when you record broadcast media or add new media files, Maestro creates a thumbprint (irreversible signature which contains no media content) that is used to dynamically update your personalized index of files. Thumbprints do not contain any personally identifiable information such as your name, the subject of the content or the content file itself. The Maestro software periodically contacts us to check for software updates. No personally identifiable information is sent in this communication. Controlling Your Personal Information The Service provides a number of tools for you to control your profile and other personal information. You can edit your profile and other information at any time through the Maestro client software. You can also adjust your privacy settings using the Maestro client to limit viewing certain information to yourself, your friends, friends of friends or make the information available to everyone. You may, of course, decline to submit personally identifiable information through the Maestro Sites, in which case Maestro may not be able to provide certain services to you. You may update or correct your personal profile information and email preferences at any time by viewing your account profile on www.maestro.fm. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you profile access or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times. At any time, you can terminate your account which will remove your profile and other personal information from view. Contact Maestro to terminate your account or to ask any other questions about your personal information. Transfer of Information We reserve the right to transfer your personal information in the event of a transfer of ownership of Maestro, such as acquisition by or merger with another company. In such an event, Maestro will notify you before information about you is transferred and becomes subject to a different privacy policy. Others' Information If you invite another person to join Maestro, we will ask for that person's name and email address. We use this information to contact and, if necessary, remind that person that he or she has been invited to join Maestro. All invitees are provided with the option not to receive further invitations from Maestro. We may disclose such information if required to do so in order to comply with valid legal process. Security and Confidentiality We use industry standard security measures to protect your information so that it is not made available to unauthorized parties. If you have any questions regarding which measures and techniques we use, feel free to contact us. - If you forget your password, you will be asked to go on the Site, insert your email address, and follow the instructions that will be sent to this email address to create a new password. No plain text passwords will ever be passed through e-mail. - Your Web-based access to your personally identifiable information is protected by an encrypted password. We recommend that you do not disclose your password to anyone. The security of your personally identifiable information also relies on customers protecting their Maestro password. If you suspect that someone may have obtained access to your password, please change it immediately by signing in to your account at www.maestro.fm/ to manage your "myMaestro Account Settings." - Additionally, your personally identifiable information resides on a firewall-protected server that only selected Maestro personnel have access to via password. Children's Policy Maestro is committed to protecting the privacy of young children. For this reason, Maestro does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information on the Maestro Sites from children under the age of 13. Furthermore, Maestro does not target its services, software or this Site to children under the age of 13 as well. We encourage parents and guardians to take an active role in their children's online activities and interests. If Maestro becomes aware that the personally identifiable information of such a person has been collected on the Maestro Sites without verified parental consent, then we will take the appropriate steps to delete said information. Special Note to International Users The Maestro Sites are hosted in the United States and are intended for and directed to Users in the United States. If you are a User accessing the Maestro Sites from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the Maestro Sites, which are governed by U.S. law, this Privacy Notice, and our Terms of Use, you are transferring your personal information to the United States and you consent to that transfer. Information Provided to Maestro Customer Service. The Maestro service may offer support and technical assistance via telephone or e-mail ("Customer Service"). When you communicate with Customer Service, you do so with the understanding: that a Customer Service team member may view and make changes to your personal information in order to provide the assistance that you need and that Maestro Customer Service may reply to you via email, phone or text message. Cookies We send "cookies" to your computer and use such cookies as described here. A cookie is a piece of data that identifies you as a unique user. We use cookies to improve the quality of our service and make the service easier to use for our members. We do this by storing information about a particular login session in cookies in order to provide you a seamless experience during a particular login session. When you logout of the Service and exit the application your session cookie information is removed. Links to Other Sites Maestro may contain links to other web sites. These other sites maintain their own policies regarding cookies and the collection and use of personal information. Changes to Privacy Policy The terms of this Privacy Policy governs the use of any information collected by Maestro and the Maestro service. Maestro reserves the right to change this policy at any time. In the event of a material change to the Privacy Policy, we will replace the "Privacy Policy" link on the home page of our web site with a link entitled "Privacy Policy Updated xx/xx/xxxx" for at least 30 days. All changes to the Privacy Policy will be effective when posted, and your continued use of the Maestro web site or the Maestro service after the posting will constitute your acceptance of, and agreement to be bound by, those changes.
